End User License Agreement

Please read this End User License Agreement ("Agreement") carefully before clicking the "Agree" button, downloading, or using Rotaro ("Application").

By downloading or using the Application, you are agreeing to be bound by the terms and conditions of this Agreement. If you do not agree to the terms of this Agreement, do not download or use the Application.

1. License Grant

The Apes of Thoth grants you a revocable, non-exclusive, non-transferable, limited license to download, install, and use the Application strictly in accordance with the terms of this Agreement. This license is for your personal, non-commercial use only.

2. Restrictions

You agree not to, and you will not permit others to:

• License, sell, rent, lease, assign, distribute, transmit, host, outsource, disclose, or otherwise commercially exploit the Application.
• Modify, make derivative works of, disassemble, decrypt, reverse compile, or reverse engineer any part of the Application.
• Use the Application for any unlawful purpose or in any manner that could damage, disable, or overburden the services of The Apes of Thoth.

3. Intellectual Property

The Application, including without limitation all copyrights, patents, trademarks, trade secrets, and other intellectual property rights are, and shall remain, the sole and exclusive property of The Apes of Thoth.

4. Your Privacy & Location Data

Your use of the Application is also governed by our Privacy Policy. You acknowledge that if you grant the Application permission to access your location, this data is processed locally on your device to enable specific features and is not stored or transmitted by The Apes of Thoth.

5. Termination

This Agreement shall remain in effect until terminated by you or The Apes of Thoth. The Apes of Thoth may, in its sole discretion, at any time and for any or no reason, suspend or terminate this Agreement with or without prior notice. This Agreement will terminate immediately, without prior notice, if you fail to comply with any provision of this Agreement.

6. Disclaimer of Warranties

The Application is provided to you "AS IS" and "AS AVAILABLE" and with all faults and defects without warranty of any kind. To the maximum extent permitted under applicable law, The Apes of Thoth expressly disclaims all warranties, whether express, implied, statutory, or otherwise, including all implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

7. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall The Apes of Thoth be liable for any special, incidental, indirect, or consequential damages whatsoever (including, but not limited to, damages for loss of profits, for loss of data or other information, for business interruption, or for personal injury) arising out of or in any way related to the use of or inability to use the Application.

8. Amendments to this Agreement

The Apes of Thoth reserves the right, at its sole discretion, to modify or replace this Agreement at any time.

9. App Store Specific Terms (Apple & Google)

Acknowledgement: You acknowledge that this Agreement is between you and The Apes of Thoth only, not with Apple, Inc. or Google LLC.

Maintenance: The Apes of Thoth is solely responsible for providing any maintenance and support services for the Application.

Third-Party Beneficiary: You acknowledge and agree that Apple and Google are third-party beneficiaries of this Agreement and have the right to enforce this Agreement against you.
